10.16.7.30 Overpayment Resulting from Arrears of Chilean Benefits

Overpayments

Article 23 of the Agreement allows for a debt to be raised against individual pensioners who have been overpaid an Australian benefit as a result of the grant of Chilean benefit. Recovery can be by cash refund or withholding from future entitlement to Australian social security pension, benefit or allowance.

In addition to the above, from 1 July 2004 a debt can be raised against the recipient and their partner (if applicable) under SSAct section 1228A. See 4.3.6.10 for more details.
