11.1.4.20 Excluded Part 3B payment nominees under income management

Excluded Part 3B payment nominees

A person will not be subject to any of the income management measures if they have an excluded Part 3B payment nominee. An 'excluded Part 3B payment nominee' is defined as a payment nominee who is:

  • a public trustee of a state or territory, as defined by that state or territory
  • a Part 3B payment nominee who is not subject to income management, or
  • an organisation.

Note: Care needs to be taken to ensure that nominee arrangements are not used as a way to avoid income management (11.1.4.30).
