11.2.9.20 Review of decision that individual is subject to income management under the Cape York Welfare Reform

Review of decision that an individual is subject to income management under SS(Admin)Act section 123UF(1) or 123UF(2) or 123UF(3)

An individual who is being income managed may request a review of the decision that they are subject to income management.

Under section 123UF(1) or section 123UF(2), the following could be reviewed:

  • whether the individual, or their partner, is an eligible recipient of a category P (11.2.5.10) or R (11.2.5.20) welfare payment, and
  • whether the written notice to place an individual on income management was given in accordance with section 123UF(1) or (2), as applicable, and
  • if the individual has a payment nominee - whether the payment nominee is an excluded payment nominee.

Under section 123UF(3), the following could be reviewed:

  • whether the individual is subject to income management under another measure, and
  • whether the individual has a payment nominee, and
  • whether that payment nominee is subject to income management under section 123UF(1) or (2).
