5.1.4 When to Claim DAPP

Introduction

DAPP can be claimed before or after the birth of a child. DAPP can only be claimed for children born or adopted, or expected to be born or adopted, on or after 1 January 2013.

A claim for DAPP is only effective if made in the period that starts on the day that is 97 days before the expected DOB of the child or expected day of placement in adoption situations. Ninety-seven days is a period equal to approximately 3 months prior to birth/placement, and this is the earliest date from which the claimant could satisfy the work test (1.1.W.30).

The end of the period during which a person may claim DAPP is:

  • the day before the child's first birthday, or
  • the day before the first anniversary of the day of the child's placement in adoption situations.

The DAPP period must be within the period from the date of birth (or adoption) until the day before the child's first birthday (or the day before the first anniversary of the child's entry into care). To receive the full 2 weeks of DAPP a person must nominate their DAPP period to start no later than 2 weeks before the day before the child's first birthday or first anniversary of the child's placement. A claim for DAPP can made up to the day before the child's first birthday or the day before the first anniversary of the child's entry into care, and the DAPP period can be backdated.

Example: If a person claims DAPP in week 51 after the child's birth, the claimant may be eligible to receive DAPP for 2 weeks only if the nominated start date is the day before 50 weeks from the DOB or date of adoption. This is because a maximum DAPP period (2.3.8) must end on the day before the child's first birthday or the day before the first anniversary of the day of placement for adoption.
