1.1.D.40 Departure from assessment

Definition

A departure from assessment is:

  • a means for the Registrar to administratively change a child support assessment (1.1.C.70) to reflect the special circumstances of a case when the child support formula (1.1.C.110) does not provide a fair level of child support (1.1.C.60). This is known as a change of assessment (1.1.C.50) (Part 5)
  • a circumstance where a parent (1.1.P.10) can apply directly to a court with jurisdiction if they are dissatisfied with a decision made by the Registrar.
