4.4.5.40 Failure to nominate bank account details

Request for bank account details

Unless an exemption is granted, an instalment claim for FTB is not effective unless the individual:

  • provides bank account details, or
  • makes a statement that they will provide bank account details within 28 days from the day the claim is lodged.

This requirement applies to both an individual (1.1.I.90) and an ACO (1.1.A.80).

If the individual meets the requirement by making a statement that they will provide bank account details within 28 days of making the claim but fail to do so, then the claim is taken not to have been made.

Act reference: FA(Admin)Act section 7A Bank account details or statement to be provided for claims for FTB by instalment to be effective, section 15A Restriction on determining claim where bank account details not provided

Policy reference: FA Guide 4.3.3 Instalments paid by direct credit

Instalment individual fails to provide bank account details

The Secretary may require a person who is entitled to be paid FTB by instalment to provide bank account details under section 26A of the FA(Admin)Act. This might occur where a bank account is closed by the individual and new account details have not been provided to Centrelink. In this situation, there may be a variation to the individual's FTB entitlement under section 27A if the individual fails to provide the bank account details within 28 days. The date of effect of the cancellation is the day after the end of the individual's latest entitlement period.

Act reference: FA(Admin)Act section 26A Secretary's power to require bank account details, section 27A Variation of instalment entitlement determination where failure to provide bank account details

Instalment individual subsequently nominates bank account

Where the instalment individual subsequently nominates a bank account into which instalments of FTB can be paid, the cancellation must be varied. The date of effect of this variation is the date of cancellation. The variation reinstates the determination that applied before the cancellation.

Act reference: FA(Admin)Act section 27A Variation of instalment entitlement determination where failure to provide bank account details
