1.1.D.20 Date of incapacity (DSP, SA)

Note: SA closed to all new enrants on 20 March 2020 and ceases on 20 September 2020.

Those receiving SA before 20 March 2020 may continue to receive the payment for the length of their medical certificate, as long as they remain eligible, or may transfer to JSP (1.2.1.05).

From 20 March 2020, SA recipients who require income support after their current medical certificate expires will transfer to JSP or another income support payment.

Definition

For the purposes of DSP and SA, the date of incapacity is the date shown on the medical certificate as:

  • the date of injury, OR
  • start date of the illness.

Exception: In some cases it may be reasonable to accept that the incapacity occurred from an earlier date than that indicated on the medical certificate.

Example: In the case of a broken limb it would be reasonable to accept incapacity from an earlier date without requiring further medical coverage.
