10.4.8.70 People exempt from the agreement rate calculation process - Agreement with Italy

People exempt from the agreement rate calculation

Some people need the Agreement to be granted an Australian benefit because they are outside Australia when they claim under the 1986 Agreement. 2 groups of pensioners within this category are not subject to the rate calculation process set out in the Agreement. These are listed below.

Disability support pension

People who became qualified to receive DSP because they became blind or incapacitated for work while in Australia, or during a temporary absence from Australia, and who:

  • were not Australian residents or absent residents on 8 May 1985, or
  • were Australian residents on 8 May 1985, and
  • left Australia on or after 1 January 1996, or
  • were granted DSP on or after 1 January 1996.

Widows

Women who became qualified to receive WidB or PPS because their husband died while they and their former husband were in Australia or during a temporary absence from Australia while they and their former husband were Australian residents:

  • so long as they were not Australian residents or absent residents on 8 May 1985, or
  • were Australian residents on 8 May 1985, and
  • they left Australia on or after 1 January 1996, or
  • were granted WidB on or after 1 January 1996.

Note: This only applies to people who were granted benefits under the 1986 Agreement.

Note: Although listed as Australian benefits covered in Article 2 of the Agreement, from 20 March 2020, WP, WidB and BVA ceased. Recipients of these payments were transferred to another payment, such as Age, where eligible and retain the exemption from the rate calculation process.
