10.7.4.10 Who Can Lodge Claims under the Agreement with Malta

Who can claim

The Agreement with Malta contains the claim lodgement provisions discussed in 10.1.4 Claiming Payments Using an Agreement.

Article 5 of the Agreement with Malta covers claims lodgement and allows:

  • residents of Australia or Malta to lodge claims for Australian benefits under the Agreement if they are in Australia, Malta or a third country with which Australia has an agreement that provides cooperation in claim lodgement, and
  • residents of third countries with which Australia has an agreement that provides cooperation claim lodgement can lodge claims for Australian benefits under the Agreement if they are in Australia, Malta or that third country.
