Where an SpB job seeker does not comply with their mutual obligation requirements there are no financial penalties placed upon the job seeker UNLESS the Secretary required them to undertake a course of study under SSAct section 736. Where nominated visa holders do not comply with their mutual obligation requirements they may be penalised under the targeted compliance framework (3.1.14) or, the job seeker compliance framework for participation payments (3.1.13) if they participate in CDP.

Failure to meet mutual obligation requirements - NVH job seekers

Compliance arrangements for SpB NVH job seekers are the same as those for NSA and YA job seekers. Different penalties apply to job seekers depending on the nature of their failure. Further detail can be found in 3.1.14 for job seekers subject to the targeted compliance framework, and 3.1.13 for job seekers subject to the job seeker compliance framework (those participating in CDP).
