Debts arising from conviction

SSAct section 1224AB does not operate to create a new debt. It simply extends liability for a debt that exists under the SSAct to a person convicted under the Crimes Act 1901 of knowingly being involved in the contravention of the SSAct that gave rise to the existing debt.

In deciding whether to raise a debt under SSAct section 1224AB, consideration should be given to any view expressed about the responsibility of the person to repay the debt by the court hearing the criminal matter.
