1.1.G.30 Guidance & appeals panel

Definition

The guidance and appeals panel provides a mechanism for escalating significant issues and addressing material errors in ART decisions. The guidance and appeals panel is a way of constituting the ART for review at a more senior level. The guidance and appeals panel can:

  • hear and determine a matter referred to it by the President of the ART that raises an issue of significance to administrative decision-making, and
  • review and determine ART decisions referred to it by the President of the ART that may contain an error of fact or law materially affecting the decision or that raise an issue of significance to administrative decision-making.

Matters and decisions can be considered by the guidance and appeals panel where the President of the ART refers them to the panel on their own-initiative or upon application by one of the parties to an ART decision. However, applications for a review by the guidance and appeals panel can only be made for ART decisions related to ART reviewable employer decisions (1.1.A.03).
