10.1.3.10 Benefits Covered in Agreements

Benefits covered in agreements

The Legislative Scope Article (usually article 2) sets out the legislation to which an agreement applies in both Australia and the agreement country and specifies the benefits covered.

This article also allows for subsequent legislative amendments relating to benefits covered by the agreement to apply to those benefits.

Example: If the name of a benefit is changed, it continues to be covered by the agreement under its new name.

Agreements may restrict a payment to a certain class of people in order to achieve reciprocity.

Example: An agreement may make Australia's PPS only available to de jure widows to align with the other country's scheme which restricts survivor payments to widows.
