10.23.9.40 Former Residents - Agreement with Greece

Former residents

SSAct section 1220(1) provides that former residents who return to Australia, who are granted an age pension, then subsequently leave within 24 months, will no longer be entitled to that pension outside Australia.

The Agreement effectively overcomes this restriction for former residents who return to Australia and claim a benefit under the Agreement and subsequently leave Australia within 24 months to live in Greece. However, people paid under the Agreement who reside in Greece and are paid under the AWLR denominator of 44 years would remain on the 44 year denominator if they subsequently returned to Greece within 2 years.
