1.1.P.30 Partner, partner in gaol

Summary

The term 'partner' has the same meaning for FA as under the SSAct.

Definition: partner

A partner in relation to an individual who is a member of a couple (1.1.M.50), is the individual's current partner, whether legally married or otherwise. This excludes former partners, whether legally married or otherwise, from whom individuals have separated.

Definition: partner in gaol

An individual is in gaol if the individual is:

  • imprisoned in connection with the individual's conviction for an offence
  • being lawfully detained in a place other than a prison, in connection with the individual's conviction for an offence, or
  • undergoing a period of custody pending trial or sentencing for an offence.
