2.8.1.70 ACCS (child wellbeing) - backdating in exceptional circumstances
Summary
All ACCS (child wellbeing) certificates (1.1.C.15) and ACCS (child wellbeing) determinations (1.1.D.78) can be backdated up to 28 days. An approved provider (1.1.A.90) can apply to backdate a certificate or determination up to 13 weeks only in exceptional circumstances.
The exceptional circumstances are:
- the eligible individual, their partner, or the child is affected by domestic or family violence
- the eligible individual, their partner, or a child of the family is experiencing serious illness, a medical condition, or hospitalisation, and the illness, condition or hospitalisation prevents the individual or their partner from working or caring for their child
- the eligible individual, their partner, or a child of the family is experiencing serious mental health issues that prevent the individual from working or caring for their child
- the child is in a formal foster care arrangement
- a long term protection order is in place in respect of the child
- the eligible individual, their partner or the child is homeless
- the eligible individual, their partner or the child is affected by the harmful use of alcohol or another drug.
The approved provider must submit third-party evidence to support the relevant exceptional circumstances.
