10.2.4.10 Who Can Lodge Claims under the Agreement with New Zealand

Who can claim

Article 6 of the Agreement allows people residing in Australia who are entitled to receive a New Zealand benefit to lodge a claim for that benefit while they are residing in Australia. This includes if she or he:

  • is either:
    • ordinarily resident and present in Australia, or
    • present long term in Australia, and
  • has been a New Zealand resident at any time in his or her life for a continuous period of at least one year since attaining the age of 20 years, and
  • in the case of NZS or a veteran's pension, has reached pension age under this Agreement.

Article 7 of the Agreement allows a person entitled to receive a New Zealand benefit to claim that benefit if he or she:

  • is present long term in New Zealand,
  • qualifies for an Australian benefit under the Agreement, and
  • in the case of NZS or a veteran's pension, has reached pension age under this Agreement.

Article 11 of the Agreement allows people residing in New Zealand who are entitled to receive an Australian pension to lodge a claim for that benefit provided they are:

  • an Australian resident or New Zealand resident, and
  • present long term in Australia or New Zealand.
