10.2.2 Terms Used - Agreement with New Zealand
Introduction
This section deals with terms used in the Agreement with New Zealand.
Defined terms
Article 1 - Definitions - defines key terms used in the Agreement. Some terms are defined because their meaning is different from the definition in domestic legislation. Others are defined because they have specific meanings in Australia and/or the agreement country. Terms not defined have the same meaning they have under the laws of the country applying the Agreement. See 10.1.2.20 for terms defined in agreements.
Once defined, the terms are used consistently throughout the text of the Agreement unless an Article specifically states otherwise. It is important to note the meaning of the following words and terms that are defined in the Agreement:
- Australian resident is defined in Article 5,
- Benefit is defined in Article 1,
- Competent authority is defined in Article 1,
- Competent institution is defined in Article 1,
- Date of severe disablement is defined in Article 1,
- Legislation is defined in Article 1,
- Living alone is defined in New Zealand legislation,
- Month is defined in Article 1,
- New Zealand resident is defined in Article 5,
- Pension age is defined in Article 1,
- Permanent resident of Australia is defined in Article 5,
- Present long term is defined in Article 1,
- Severely disabled is defined in Article 1,
- Social security law is defined in Article 1,
- Supported living payment is defined in Article 1,
- Territory is defined in Article 1,
- Third country is defined in Article 1,
- Third country pension is defined in Article 1,
- Third country residence is defined in Article 5,
- Working Age Residence (WAR) is defined in Article 5,
- Year is defined in Article 1,
- 1994 Agreement is defined in Article 1,
- 1994 Agreement benefit is defined in Article 1, and
- 2001 Agreement is defined in Article 1.
