5.2.2.40 Permission to claim flexible PPL days

Introduction

Some claimants require permission to claim flexible PPL days in order to be payable on a day.

The birth mother of a child may give permission to claim flexible PPL days for the child to:

  • the other parent of the child
  • the partner of the birth mother, and
  • the partner of the other parent of the child.

An adoptive parent who is payable for PLP for the child, or who has been nominated by the partner of an adoptive parent, may give permission to claim flexible PPL days for the child to:

  • a subsequent claimant adoptive parent, and
  • a partner of an adoptive parent.

A PPL claimant in exceptional circumstances for whom a payability determination under the PPLAct section 13 that PLP is payable for the child is in force, may give permission to claim flexible PPL days for the child to their partner.

The permission must:

  • be given to Centrelink in the form required
  • specify the number of flexible PPL days that may be claimed, and
  • specify the person to whom the permission is given.

The permission does not preclude the person providing the permission from making a claim for some or all of the flexible PPL days specified in the permission.

Where a claimant requires permission to be payable, PLP will not be payable unless:

  • the appropriate person has given permission for that person to claim flexible PPL days
  • the permission has not been revoked, and
  • if the determination were made, the number of flexible PPL days that would be payable to the person would not exceed the number of flexible PPL days specified in the permission.

Note: In order to be payable for PLP a person must be eligible on the relevant day. A person will not be eligible on a flexible PPL day if the maximum entitlement for the person or the child have been reached.

Note: Some claimants require permission to make claims in order to make an effective claim (4.1.6).

Revocation of permission

A person who has given permission to claim flexible PPL days may vary or revoke that permission. The variation or revocation must be made in the form required by Centrelink.

Permission cannot be revoked for payable flexible PPL days that have already occurred (that is, past days).

Permission can been revoked for payable flexible PPL days that have not yet occurred. Where this occurs, Centrelink must vary the payability determination to remove the days that exceed the number of days specified in the permission as varied, and determine that PLP is not payable to the person for those days.
