Transitional provisions
Because this Agreement replaces the previous Agreement with Portugal it is necessary to include transitional provisions to cover people who are being paid under the previous Agreement when this one entered into force. The transitional provisions ensure that this Agreement will not adversely affect anyone currently being paid under the previous Agreement.
Article 31 ensures that a person's qualification to receive a benefit under the previous Agreement will not be affected by the terms of this Agreement.
Example: A person who is not severely disabled and is receiving DSP under the previous Agreement will continue to qualify for that payment indefinitely while they are in Portugal.
