10.32.6 Requirement to Claim a Pension from India

Requirement to claim a pension from India

The Agreement with India does not contain special provisions to make it compulsory for people claiming Australian pensions under the Agreement to also claim an Indian benefit. However, the SS(Admin)Act requires that all Australian pensioners take reasonable action to claim a comparable foreign (CFP) entitlement from overseas. This requirement is covered by CFP legislation explained in 7.3.1.
