10.8.9.30 People Who Travel to a Third Country - Agreement with the Netherlands

Third country portability

Article 5 of the Agreement with the Netherlands provides that benefits paid under the Agreement may be paid to people who travel to a third country if those benefits are payable in third countries under domestic legislation. Article 5 also provides that if time limitations apply on benefits for people who leave Australia, then those same time limitations apply to people who leave the Netherlands.

See 7.1 for information on portability of benefits paid to people under the Agreement who leave the Netherlands or Australia and travel to a third country.

A person who receives a benefit under the Agreement with the Netherlands who leaves the Netherlands for a third country, will continue to qualify for that benefit under Article 23(5) of the Agreement if Australia has implemented an agreement on social security with that third country which provides for portability of that benefit.
