12.3.1 Moving from the income management regime to the enhanced income management regime
Introduction
Following commencement of the Social Security (Administration) Amendment (Income Management Reform) Act 2023, people currently subject to the income management regime (Part 11) can choose to move to the enhanced income management regime.
A person can choose to transfer from the income management regime to the enhanced income management regime by requesting a transfer.
An income management participant will also move to enhanced income management if they lose eligibility for their current income management measure and are subsequently eligible for a measure under the enhanced income management regime.
Requests to transfer from the income management regime
A person who is subject to the income management regime under SS(Admin)Act section 123UC (11.3), section 123UCA (11.4), section 123UCB (11.5), section 123UCC (11.6) or section 123UFAA (11.9) may make a request to the Secretary to transfer to the enhanced income management regime, including a person with a Part 3B payment nominee. The request cannot be withdrawn or revoked.
If a person makes a request to transfer, the Secretary must give the person a written notice within 28 days stating that the person is eligible to transfer to the enhanced income management regime.
Volunteers
A person on VIM must end their VIM arrangements, and then volunteer for enhanced income management (12.3.5) to move to enhanced income management.
Nominees
A Part 3B payment nominee is able to choose to move to the enhanced income management regime. The principal for the Part 3B payment nominee will continue to be eligible under their current measure, which may be under the income management regime or the enhanced income management regime (12.1.5).
