4.5.3 Income Apportionment Resolution Scheme

Introduction

Schedule 3 of the Social Security and Other Legislation Amendment (Technical Changes No. 2) Act 2025 establishes the Income Apportionment Resolution Scheme (the Resolution Scheme). The Resolution Scheme provides individuals with a one-off resolution payment for each income apportionment affected debt.

The Resolution Scheme commenced on 30 January 2026 and will be open for applications from this date until application closure on 29 January 2027. An extension of time to apply until 29 January 2028 may be allowed where special circumstances prevented a person from applying during the application period.

The Income Apportionment Resolution Scheme Determination 2025 (the Determination) sets out provisions for and in relation to the Resolution Scheme.
