9.3.5 Compensation for acquisition of property

Summary

The NRSAct sets out that, if the operation of the Act would result in an acquisition of property, set out under paragraph 51(xxxi) of the Commonwealth of Australia Constitution Act, from a person otherwise than on just terms, the Commonwealth is liable to pay a reasonable amount of compensation to the person (to be agreed between the Commonwealth and the person, or as determined by a relevant Court).
