Persons subject under Queensland Commission
The Family Responsibilities Commission (FRC) is the body specified as the 'Queensland Commission' under the SS(Admin)Act.
Since 2008, the FRC has had responsibility for referring individuals within the Cape York and surrounding regions onto income management. In March 2021, the CDC rolled out in the Cape York and Doomadgee regions and eligible individuals within those areas became participants in the CDC program rather than the income management regime. From 17 March 2021, a notice issued by the FRC that required a person to become subject to income management had the effect of referring an individual to the CDC program.
From 6 March 2023, a notice given by the FRC has the effect of referring individuals onto the enhanced income management regime rather than the CDC program. Individuals residing in the Cape York and Doomadgee regions who were participating in the CDC program transitioned to the enhanced income management regime from 6 March 2023 until the end of their notice.
On or after 6 March 2023, individuals residing in the Cape York and Doomadgee regions will become subject to the enhanced income management regime if:
- the individual, or the individual's partner, is an eligible recipient of a category A welfare payment (12.2.2)
- the FRC has given a valid notice to the Secretary requiring that the individual be subject to the income management regime
- the notice was given prior to 6 March 2023, the person was a CDC program participant immediately before that date
- the notice has not been revoked, withdrawn, or expired
- the individual has a Part 3B payment nominee – that nominee is subject to the income management regime or the enhanced income management regime.
