8.3.2 Collection from third parties

Context

The Registrar can issue a notice to someone who owes money to a relevant debtor requiring that the money be paid to the Registrar in satisfaction of relevant debts. This power is separate from the Registrar's power to collect child support (1.1.C.60) through employer withholding (1.1.E.20) (7.4.3), or deduct amounts from Australian Government payments (7.4.4) or tax refunds (8.3.1).

If a person within Australia is controlling money on a relevant debtor's behalf while the relevant debtor is overseas, a notice may be issued requiring the money be paid to the Registrar.

See 8.3.1 for the definitions of 'relevant debt' and 'relevant debtor'.

Act reference: CSRC Act section 72A Registrar may collect debts from a third person, section 72AC Deductions from veterans’ pensions and allowances, section 72B Person receiving or controlling money of a debtor who is outside Australia
