6.3.6.30 Waiver of debts arising from offence

Summary

Centrelink must waive the right to recover so much of a debt that arises from an offence if:

  • the debtor is convicted of the offence, and
  • the court indicated in sentencing the debtor that it imposed a longer custodial sentence on the debtor because he or she was unable or unwilling to pay the debt.
