The parental income test for allowance customers under 18 years of age is based on taxable family income and the number of dependent children in the family. While for youth training allowance and sickness allowance a dependent child under 23 years of age attracts an additional free area.

From 20 March 1996 legislative changes were introduced that amended the rules for incapacitated youth training allowance and sickness allowance. Unemployed customers on allowance who are temporarily incapacitated for more than 13 weeks due to illness or injury, no longer have to transfer to sickness allowance.

National instruction CB970174 erroneously advised network staff that the income maintenance period did not apply to sickness allowance. Payments of sick leave are assessed in accordance with guidelines 14.2600 to 14.2606.

From 20 March 1997 a person is qualified for an age pension if the person has reached age pension age and any of the following applies:
- The person has ten years qualifying Australian residence.
- The person has a qualifying residence exemption for an age pension.
- The person was receiving a widow B pension, a widow allowance, a mature age allowance or a partner allowance, immediately before reaching that age;
- If the person reached age pension age before 20 March 1997 - the person was receiving a widow B pension, a widow allowance or a partner allowance, immediately before 20 March 1997.
A woman is qualified for an age pension if:
a) the woman has reached age pension age; and
b) the woman's partner has died; and
c) both the woman and her partner were Australian residents when her partner died; and
d) the woman was an Australian resident for a continuous period of at least 104 weeks immediately before the day she lodged the claim for the age pension.

From 20 March 1997 there are no new grants of widow B pension. Current cases remain eligible unless otherwise disqualified. Suspension rather than cancellation should be used for periods of short term earnings.
From 20 March 1997 there is no longer an age pension residency requirement for people who are receiving widow B pension immediately before they turn age pension age, or who are over age pension age. As widow B pensioners reach the women's age pension age they are automatically transferred to age pension from the following pension payday without having to lodge a claim. Widow B pensioners paid under an international agreement or overseas or in receipt of ongoing compensation payments are not transferred to age pension.

Where a surviving partner is a women aged 50 or over, with no recent workforce experience, then her eligibility for widow allowance should be explored. A claim for widow allowance should be invited where appropriate.
Where a surviving partner is a woman of age pension age who was not residentially qualified for an age pension, then her eligibility for an age pension under subsection 43(1A) of the Act should be explored. from 20 March 1997 a woman can qualify for an age pension if:
(a) the woman has reached age pension age; and
(b) the woman's partner has died; and
(c) both the woman and her partner were Australian residents when her partner died; and
(d) the woman was an Australian resident for a continuous period of at least 104 weeks immediately before the day she lodged the claim for the age pension.
If a survivor meets the criteria above she should be invited to claim age pension. If she already receives age pension paid under an agreement but her rate is reduced due to direct deductions of overseas pension, she can reclaim to qualify for a higher rate of pension.

This policy has now been changed to require that the above submissions are to be forwarded to the FAS of the relevant policy Division. The rationale for this change is that both CDDA and act of grace payments are 'ex gratia' type payments that allow the Department to compensate even though there is no legal liability to pay. That is, it is generally a policy decision as to whether it is appropriate to recommend compensation under either of these discretionary payments.
