6.8 Offences & prosecution

Introduction

This chapter describes the offence provisions contained in the child support legislation. It does not deal with offences under the Crimes Act 1914 and the Criminal Code Act 1995 (e.g. forgery).

The information in this chapter applies to WA ex-nuptial children. See 1.4 for more details regarding when provisions apply for WA ex-nuptial cases.

Penalty unit

From 1 July 2020, the penalty unit amount is $222.

A penalty unit is defined in the Crimes Act section 4AA as being equal to $210 from 1 July 2017.

The penalty unit amount is to be automatically indexed in line with the change in the CPI on 1 July 2020 and each third 1 July following that day.
