1.1.R.30 Recovery order

Definition

A recovery order is an order made by the court requiring a former payee (1.1.P.30) to repay a former payer (1.1.P.40) a specific amount of child support (1.1.C.60) for a child of whom the former payer is:

  • not the parent (1.1.P.10) or
  • when the registered maintenance liability should never have existed.

Note: The amendments to CSA Act section 143 made by the Family Assistance and Child Support Legislation Amendment (Protecting Children) Act 2018 applies to decisions or findings by a court made after 1 July 2018.
